History:
Assembly Bill 939, known as the California Integrated Waste Connections Act of 1989, was passed because of an increase in waste stream and the decrease in landfill capacity. AB 939 mandates a reduction of waste being disposed. All jurisdictions were required to divert 50% of their waste from the landfill by the year 2000. El Dorado County did not meet the year 2000 diversion goal. The County achieved a 38% diversion rate in the year 2001. The County applied for and received a time extension until July 1, 2004. Failure to meet the diversion mandate of 50% by July 1, 2004 may result in fines of up to $10,000 per day for each day of noncompliance. Construction and demolition (C&D) debris is a major barrier to achieving the 50% requirement. An estimated 15-20% of the County's disposed waste stream consists of C&D materials (e.g. lumber, concrete, rock, and soil).
New Ordinance & Requirements:
On September 30, 2003, the Board of Supervisors of the County of El Dorado passed and adopted a construction and demolition debris recycling ordinance. This ordinance adds Chapter 8.43 to the El Dorado County Ordinance Code. Chapter 8.43 requires individuals or businesses demolishing or constructing projects with structure footprints exceeding 5,000 square feet in area to recycle at least one-half of the construction and demolition debris created.
